On October 1, 2016 Montgomery County's new Earned Sick and Safe Leave Law goes into effect. This law requires all employers operating and doing business in Montgomery County to provide at least some paid Sick Leave to employees performing work in the county. The law has many potential pitfalls regarding such issues as accruing and calculating the amount of leave, when leave can be used, and notice and recordkeeping requirements. This presents special challenges for home care businesses. In addition, home care business need to aware of already enacted and proposed future increases in the minimum wage in Montgomery County, Prince George’s County, and Baltimore as well as statewide, and of changes in the Federal minimum salary for exempt employees.
